PRIVACY STATEMENT – DIGITAL ART CENTER


Introduction


Digital Art Center B.V. (“DAC”), incorporated in the municipality of Rotterdam and having its registered office at Willemsplein 79, 3016
DR, collects and processes your personal data necessary for the
organisation of events we host. In doing so, we always respect your
privacy. We safeguard your data effectively and comply with the provisions of the General Data Protection
Regulation (also: “GDPR”) and other applicable
privacy legislation.


In this Privacy Statement, we briefly explain what personal data we collect, how we use
it, and what your rights are. This Privacy Statement applies to all parties whose personal data
we process (including but not limited to visitors and/or participants at
events, counterparties, website visitors to https://remastered.nl, purchasers of our
services and/or products, suppliers and job applicants), with the exception of employees,
contractors and/or other individuals who carry out work for DAC. We apply a separate privacy statement to the latter
data subjects.


Data controller


We are Digital Art Center B.V., also known as ‘Remastered’ (our event name). We are
responsible for the processing of your personal data. This means that we determine which
personal data we collect and process, for what purposes, and by what means.

What personal data do we process?


DAC may process the following (types or categories) of personal data for the purposes of
providing its services:

  • Personal details and other personal data required to purchase a
    ticket for one of our events, to purchase our products and/or to enable us to organise our
    events and conduct business with you;
  • date of birth;
  • telephone number;
  • email address;
  • bank account number;
  • information about your activity on our website;
  • IP addresses;
  • in the case of job applicants: details as set out in the CV, including information on
    education and training, employment history and other details relevant to the
    performance of the role;
  • any other information necessary for the purposes mentioned above.

DAC processes the aforementioned personal data because it has been provided by you, the data
subject, on your own initiative; obtained in the course of providing our services; disclosed to us by third parties, including
counterparties; or has become known to us through public sources.


Special categories of personal data and/or sensitive personal data that we process.


Our website and/or service does not intend to collect data about website visitors
under the age of 16, unless they have parental and/or guardian consent. However, we
cannot verify whether a visitor is over 16. We therefore advise parents to be involved in their
children’s online activities, in order to prevent data about children from being
collected without parental consent. If you believe that we have collected personal data about a minor without such
consent, please contact
us at info@remastered.nl, and we will delete this information.

Why do we process your personal data?


We collect and process your personal data for the following purposes:

  • organise events;
  • to sell tickets for our events and to
    process the associated payments;
  • to sell products via our online shop and/or our physical shop and to
    deliver them;
  • to keep our records;
  • to collect invoices;
  • to comply with our legal and regulatory obligations;
  • to carry out marketing and communication activities (including sending out our
    newsletter);
  • to analyse website usage;
  • recruitment and selection (job applications);
  • communication with suppliers and other third parties;
  • to ensure the security of our (IT) systems;
  • defence against (legal) claims;
  • other legitimate (business) interests.

How do we obtain your personal data?

Your personal data, such as your name, email address, telephone number and IP address, is
collected, for example, during the registration process (when you purchase an admission ticket or
a product from our online shop), when you do business with us and/or when you visit our
website. We may receive your data directly from you or via a third party
(for example, a referral partner). Further information will be obtained directly
from you during your relationship with us, for example through communication with you,
user support or surveys.

There may be more than one reason for processing your personal data. Furthermore, the reason(s) for
processing your personal data depend on whether you are a visitor to our
website, a customer or another data subject. Legal basis for processing personal data DAC processes
the personal data mentioned above exclusively on the basis of (one or more of) the grounds set out
below, as referred to in Article 6 of the GDPR:

  • legal obligation;
  • performance of a contract;
  • consent obtained from the data subject(s);
  • legitimate interest.

Who do we share your personal data with?

We treat your data as strictly confidential. We will only share your personal data with third parties we
engage if it is necessary for them to process it.
In such cases, we enter into confidentiality agreements with these parties and, where necessary,
data processing agreements. The following parties or individuals may have access to your
personal data:

  • Ticketcounter.com provides us with software to support the ticket sales process. We have entered into agreements with
    Ticketcounter.com regarding the security and confidentiality of your
    personal data;
  • the employees, agency workers and self-employed contractors engaged by us who are involved in organising the events
    and in direct contact with you. They only have access to personal data when
    they are actually carrying out their duties (where
    necessary). At other times, they do not have access to such data;
  • Payment provider Adyen N.V.
  • parties engaged for hosting purposes;
  • parties engaged for administrative purposes and customer service.

We do not transfer personal data to parties outside the European Economic Area (EEA,
which comprises all EU countries plus Liechtenstein, Norway and Iceland).

Cookies


The DAC website uses cookies to ensure the website functions
properly (functional cookies) and to track customer behaviour on the website (other cookies).
A cookie is a small text file that is stored in
the browser of your computer, tablet or smartphone when you first visit this website. DAC uses cookies with a purely technical
function. These ensure that the website works properly and that, for example, your
preferred settings are remembered. These cookies are also used to ensure the website
functions correctly and to enable us to optimise it. In addition, we place cookies that track your browsing
behaviour so that we can offer tailored content and advertisements. On your first
visit to our website, we already informed you about these cookies and asked for your
consent to place them. You can opt out of cookies by setting your
internet browser so that it no longer stores cookies. You can also delete all
information previously stored via your browser settings.


DAC uses Google Analytics, a web analytics service provided by
Google Inc. Google Inc. may share the information collected with third parties where required by law
or where such third parties process the information on Google’s behalf. DAC
does not use Google Analytics to collect personal data, with the exception of the IP address of visitors using the
website.


Finally, DAC uses tracking cookies – these are ‘advertising cookies’ – which we may
use to track your browsing behaviour on our website so that we can offer you personalised online
advertisements. Specifically, we use tracking cookies provided by Google
(DoubleClick and AdWords) and Meta.


Functional and analytical cookies do not affect your privacy, so we
do not need to ask for your explicit consent for these. We therefore only ask for your consent to use
tracking cookies. The information collected by these cookies is stored for a maximum of 90 days. You can always disable
cookies yourself or delete them from your device. How you do this varies depending
on your web browser and device.


How is your personal data protected?


Access to your personal data within our organisation is restricted by passwords,
two-factor authentication and access protocols. We
never retain your personal data for longer than is strictly necessary; this also applies to
CCTV footage obtained through surveillance of the event venue. Furthermore, as a general rule, we apply a maximum retention period of four weeks for
CCTV footage.


What are your rights?


When it comes to your personal data, you have various rights:

  • right of access: the right to access the personal data we hold about you;
  • right to rectification: if the personal data we hold about you is inaccurate, you may ask us
    to rectify it;
  • right to erasure: if you believe there is no reason for us to continue
    processing your personal data, you may request that it be deleted;
  • right to restriction of processing: in certain circumstances, you have the right to request that we restrict
    processing;
  • right to object: if we process your data on the basis of a legitimate interest, you
    have the right to object to this;
  • right to data portability: this means that you have the right to receive your personal data in a
    structured, commonly used and machine-readable format and to transfer this
    data to another party.

If the processing is based on your consent, you also have the right to withdraw your consent
at any time (without this affecting the lawfulness of the processing
that was already based on your consent prior to the withdrawal). However, if the processing of
personal data is (also) based on another legal basis, we may continue to process your
personal data.
In addition, you have the right to lodge a complaint with the Dutch Data Protection
Authority (www.autoriteitpersoonsgegevens.nl).
Finally, what happens if you do not wish to provide us with personal data? As the
provision of certain information is a contractual requirement should you wish
to use DAC’s service(s), failure to provide such information may affect
DAC’s ability to enter into or continue a contract with you and to allow
you to use our services. In other cases, it may prevent you from accessing (parts of) our website or
the events we organise.
